New Bill Puts Californians' Medical Privacy at Risk

Assembly Bill 2746 could force lenders to need access to clinical details about your medical care to comply with the proposed law.

Lenders could need to know what services you received, if they were "medically necessary" and potentially even your diagnosis or treatment details if AB 2746 were to become law. It could also require lenders to be informed about personal health items purchased at retail stores.

What does AB 2746 (Schiavo) do? 

AB 2746 (Schiavo) would force lenders into a system where they could be required to access clinical details about your medical care just to comply with this proposed law. This would include sensitive and private medical information that should stay between you and your health care provider. 

Why does Californians for Medical Privacy oppose AB 2746 (Schiavo)? 

Currently, lenders do not have access to private medical information. The bill could force lenders obtain sensitive medical information to ensure compliance with the law.  This could mean lenders would need to know what services you received and find out if those services were “medically necessary.” It could also require lenders to be informed about personal health items purchased at retail stores.

None of this is information a lender should have. It would roll back long-standing medical privacy protections and result in a historic shift in California privacy laws, all of which would be necessary for the lender to comply with the newly proposed law.  

Why is Californians for Medical Privacy asking people to oppose AB 2746 (Schiavo)? 

Your voice matters most. Lawmakers need to hear directly from you – their constituents – that you do NOT want lenders accessing your private medical information. AB 2746 (Schiavo) is the wrong approach, and you can help stop it.

When will AB 2746 become law? 

The bill must be passed by the California Assembly and California Senate. It would then go to Gov. Gavin Newsom. If the Governor signs it into law, AB 2746 (Schiavo) would take effect in 2027.
